This Privacy Policy, as may be amended from time to time (hereafter, “Privacy Policy”), discloses the privacy practices regarding all information gathered from or about you ("Personal Information"), including in person, via any websites, mobile applications, social media pages, written or typed questionnaires, electronic transmissions, short message services, facsimiles, telephonic communications, and all services, software functionality, or materials (collectively, the “Sources“) collected by or on behalf of K. Hovnanian Companies, LLC or its affiliates (“Hovnanian“, “us” or “we“).
We understand the importance that our customers place on privacy - we take your privacy seriously, too. Our Privacy Policy is the same for former customers, current customers and prospective customers. We have designed this Privacy Policy to describe our information-gathering and dissemination practices. You consent and agree to this Privacy Policy and our Terms and Conditions of Use of our website, which can be found here, when you access or use any Sources or communicate with us. If you do not consent or agree to this Privacy Policy, please do not access or use any of our Sources or communicate with us (as a basis for processing your Personal Information is your consent to this Privacy Policy). If you wish to withdraw your consent, please follow the procedures set forth below to withdraw your consent (in whole in or part) by following our opt-out procedures. Please note that we reserve the right to review and update this Privacy Policy from time to time. If we make any material changes to the Privacy Policy, a notification will be made by means of a general notice displayed on certain Source(s) prior to the change taking effect. WHAT INFORMATION DO WE COLLECT ABOUT YOU AND WHY?

Some Personal Information is classified as "Sensitive Personal Information" or "SPI." This includes information like social security numbers, login information, financial information, precise geolocation information, information on your racial or ethnic origins, religious or philosophical beliefs, biometric or genetic information that can be used to identify you, or other personal information like sexual orientation. However, this does not include anything that you have posted online for the general public to see, or is otherwise publicly available.
How We Use Information We Collect
Hovnanian will use and disclose the information we collect for any lawful purpose we deem appropriate. This includes in connection with your purchase of a Hovnanian home; to fulfill your requests; to answer your questions; to manage our business; to recruit and hire employees; to protect our interests; to comply with law enforcement; and, to support direct marketing and other opportunities of Hovnanian and third parties as described in this Privacy Policy. In this regard, we may contact you by email, postal mail, text message, social media, telephone or other means regarding our products, services, promotions and employment opportunities.

Cookies and Other Tracking Technologies That We Use
We and our Service Providers use cookies, beacons, embedded scripts and local shared objects in connection with certain of the Sources.

The types of usage information that Hovnanian collects may contain generic information about you when you visit, access, or use our website or any of the Sources, which may include, among other things, the following categories of information (collectively, “Usage Information”):

We may provide your Personal Information (excluding information we receive from consumer or other credit reporting agencies) and Usage Information to various individuals and companies, as permitted by law, without obtaining your prior authorization. Please see the section below titled “Choices with Your Personal Information” to learn how to limit the discretionary disclosure of your Personal Information and Usage Information.
We may allow web analytics providers and other third parties including our advertisers, email vendors, service providers, and other service companies to collect information, including Personal Information, about your online activities, over time and across different web sites, when you use tour website. If you are a Hovnanian homeowner or prospective homeowner, we share your information, which may include Personal Information, with our subcontractors, service providers and developers of communities (for example, electricians, painters, land developers and telecom providers) in connection with your purchase of a Hovnanian home and in response to your warranty or customer service requests and to provide services to you and our other homeowners. We may share your information with service providers who perform services on our behalf, such as those service providers that perform technology services for us.

For example, aggregate data may include De-identified Data that describes the general demographics, usage or other characteristics of certain Sources' users. We reserve the right to transfer or keep aggregate or group data about our Sources' users for lawful or legitimate purposes, such as for the purposes described in this section.
We may allow you to create a user profile for use in connection with the Sources (“Profile”). When you open an account with us and create a Profile, we may obtain, verify and record information that identifies you, including Personal Information. We may be required to verify, record or share such information to help the government fight the funding of terrorism and money laundering activities.
As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution, total or partial sale of assets in bankruptcy or similar event, Personal Information may be part of the transferred assets. You expressly agree and consent to the use and/or transfer of the foregoing information in connection with any of the above-described proceedings. We are not responsible for any breach of security or action by any of these third parties.
Some of our Sources utilize framing techniques to serve content to you from third parties while preserving the look and feel of our Sources. When you interact with content from third parties displayed on any of our Sources, please be aware that you are providing your Personal Information to these third parties and it will be governed by their respective privacy policies and terms and conditions.
We may disclose your Personal Information for any purpose disclosed by us when you provide the information. We may also disclose your Personal Information with your permission or as directed by you.

Accessing, Correcting, Updating or Deleting Personal Information, and Deactivating Your Account
You may request to access, correct, update, or delete certain of your Personal Information or deactivate your account by emailing our Customer Support at privacy@khov.com with information necessary for us to process your request, and include your state of residence, request type, and last name in the email subject line. While reasonable efforts will be made to delete all of the Personal Information as you may request, in certain circumstances retention of certain of your Personal Information may be required, including as required by law. Do Not Track Signals
We do not monitor or identify “do not track signals” from your devices and such signals will not affect the operation of the Sources. Even if you are using a device that sends a "do not track signal," we may collect, use and share Personal Information consistent with this Privacy Policy.
Children Under the Age of 18
Our website is not intended for children under 18 years of age. No one under age 18 may provide any information to, or on, the website or any of the Sources. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this website, register on the website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. HOW LONG DO WE TYPICALLY RETAIN YOUR PERSONAL INFORMATION?
Hovnanian does not intend or plan to retain any Personal Information on any users of the Source. Hovnanian reserves the rights to retain information as necessary to improve the Source and respond to legal requests. You may have the opportunity to opt-out of certain communications and modify any demographic information you've provided. Please be aware this may take some time to be processed.
Upon an event requiring deletion of your account data under law, Hovnanian deletes all the above-mentioned data in its possession within a reasonable timeframe. Hovnanian does not verify the correctness of Personal Information.
In some cases, we may not be able to delete your personal information, and will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We take reasonable steps and appropriate measures to protect data from loss, misuse, unauthorized access, disclosure, alteration, and destruction.
Please note that some data may be retained if necessary to resolve disputes, enforce Hovnanian’s user agreements, and comply with technical and legal requirements and constraints related to the security, integrity and operation of the Source.
SECURITY
We take commercially reasonable steps to help protect personal information from loss, misuse, unauthorized access, use, disclosure, alteration and destruction. However, no internet or electronic transmission is ever fully secure or error free. We do not and cannot guarantee or warrant that any information transmitted through the Internet is secure, or that such transmissions are free from delay, interruption, interception or error. ANY TRANSMISSION OF PERSONAL INFORMATION IS AT YOUR OWN RISK. In addition, e-mail sent to or from any of our Sources may not be secure, and you should therefore take special care in deciding what information you send to us via electronic transmission. Our Sources may not be available or appropriate for use in countries other than the United States. If you choose to access one of our Sources from a country other than the United States, you do so at your own risk and with the understanding that Personal Information may be collected, used, disclosed or stored in the United States. Access to Specific Information and Data Portability Rights

Deletion Request Rights
You have the right to request that KHAM delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
8. Comply with a legal obligation.
9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
California Opt-Out Rights
If you are 16 years of age or older, you have the right to direct us to not sell your Personal Information at any time (the "right to opt-out"). We do not sell the Personal Information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age.
